Charter of Fuzhou Port

Chapter One   Geographical Position and Areas

 Item 1 Geographical Position

Located at the southeast coast of mainland China and on the west bank of Taiwan Straits, Fuzhou Port is composed of estuary port and seaport. The estuary port refers to Minjiang Estuary Inner Harbor Area, while the seaports include Jiangyin Harbor Area, Songxia Harbor Area, Luoyuan Bay Harbor Area and Operating Zones at Pingtan Island such as Jinjing wharf. 

Item 2 Natural Condition

Fuzhou Port starts from Fuzhou urban areas in the west, reaches Minjiang Estuary in the east, goes as far as Xinghua Bay in the south and reaches Luoyuan Bay in the north. It possesses a large region, complex landform and varied natural condition. 

I Temperature     The perennial mean air temperature of estuary port and seaport is 19°C-19.7°C.

II Precipitation    The mean annual precipitation is 1649.5 mm in Luoyuan Bay Harbor Area and around 1330 mm in other harbor areas. 

III Fog              The fog season round January to April in Minjiang Estuary Inner Harbor Area, March to May in Jiangyin Harbor Area and winter in Luoyuan Bay Harbor Area.

IV Wind             Fuzhou Port is mostly influenced by northeast monsoon in Winter (November-March of next year), while typhoon always comes in summer (June-September). 

V Tide Level     The highest tide in Mawei, the inner harbor area of Minjiang Estuary is 6.38m, and the lowest tide is 0.49m (Luoxing Datum). The highest tide of Songxia, Jiangyin, and Luoyuan Harbor Area are 8.75 m, 7.77 m, 6.50m respectively (Theoretical Datum ) .

Item 3 Water Area

The four harbor areas of Fuzhou Port are located inside Minjiang Estuary, Xinghua Bay, Fuqing Bay and Luoyuan Bay respectively, each of them is independent in water area deployment. The harbor coastline of Pingtan Island is under planning, so its water area scope is not defined yet. 

I Minjiang Estuary Inner Harbor Area

It starts from the broken-line connected by Yijianwei Mountain, Banyangjiao, Qixingjiao and Shafengjiao to Minjiang River Jiefang Bridge and Wulongjiang Bridge along river.

II Jiangyin Harbor Area

It takes the broken-line connected by Wan’an of Xinghua Bay, Tangyu, Nanheng Island, Daqiao Mountain to the east of Nanri Island as its east harbor limit, and the flow-line formed by southeast light beacon of the Shicheng Mountain to the west of Nanri Watercourse and light beacon at the west end of Nanri Island as its south harbor limit.

III Songxia Harbor Area

It takes the broken-line connected by Niujiao of Fuqing Bay, Dongyin Island, Zhupai Island, Wuzhu Island and the northeast part of Yutou Island of Dongluo Islands and the east of Fuqing Dongying Village as its harbor limit.

IV Luoyuan Bay Harbor Area

The water area of Luoyuan Bay Harbor Area is composed of the entire water areas inside Koumen of Luoyuan Bay, encircled by the flow-line formed by Kemenjiao and Hutoujiao as well as the water areas of north and south anchorage of Kemenkou

Item 4 Land Area

I Minjiang Estuary Inner Harbor Area

It spreads over the south and north banks of downstream of Minjiang River Jiefang Bridge and Wulongjiang Bridge. It has eight operating zones, including Taijiang Operating Zone, Mawei Operating Zone, Qingzhou Operating Zone, Songmen Operating Zone, Chang’an Operating Zone, Xiaochangmen Operating Zone, Langqi Operating Zone and Choudong Operating Zone. 

II Jiangyin Harbor Area

It is located at the south part of Jiangyin Peninsula in Xinghua Bay, Fuqing City. According to the port plan, it is planned to construct into west operating zone and east operating zone. 13 kilometers coastline from Niutouwei in Jinwankou of Longgao Peninsula to Gaoshan Bay and 3.5 kilometers coastline from Renyu to Wan’an harbor are reserved as the coastline for port construction. 

III Songxia Harbor Area

It is located between west of Koumen on the north bank of Fuqing Bay and Liangcuo Village, inside Changle City. Part of land areas of the docks is located inside Fuqing City, and Niujiaozui at the northern part of the harbor area is planned to construct as Songxia Harbor Area Development Zone. 

IV Luoyuan Bay Harbor Area

Located at the south and north bank of Luoyuan Bay, it belongs to Lianjiang County and Luoyuan County respectively. It includes Kemen Operating Zone, Jitou Operating Zone, Bili Operating Zone, and Niukeng Bay Operating Zone. 

V Pingtan Island Operating Zone

Located on the west bank of Pingtandao Island, currently it contains Pingtan Jinjing  Wharf, Zhuyukou Wharf, etc. 

Item 5 Port Fairway 

I Minjiang River Downstream Fairway

With a total length of 66.6 kilometers, it is from Minjiang River Jiefang Bridge to Waisha Fairway Entrance, which is divided into two sections at the light beacon of Damajiao in Mawei. The upper section is from Mawei to Minjiang River Jiefang Bridge, which is 16.6 kilometers long, 80m wide, and the minimum navigable depth is -3.8m. The main course of lower section is from Mawei to No. 1 buoy light outside of Minjiang Estuary, which is 50 kilometers long,125m wide, and the minimum navigable depth is -5.8m; the secondary fairway is the Yanshan Watercourse from Yingqian to Rongtong wharf, which is 3 kilometers long, 100m wide, and the minimum navigable depth is -6.5m. 

II Jiangyin Harbor Area Fairway

With a total length of 44.26 kilometers, it is from the neighborhood of Xiaoyueyu in the mouth of Xinghua Bay, passes through Xinghua Watercourse and ends at Berth No. 1 in Jiangyin Harbor Area. The fairway bed is 360m wide and the minimum navigable depth is -15.0~-17.2m. 

III Songxia Harbor Area Fairway

With a total length of 13 kilometers, it is from the Dongluo Anchorage in Fuqing Bay to Yuanhong Wharf. The fairway bed is 150m wide and the minimum navigable depth is -7.3~-8.1m.

IV Luoyuan Bay Harbor Area

The fairway from the North Danyu watercourse to Jiangjunmao is 12.7 kilometer long. Its natural depth is navigable forbulk carriers up to 300,000 DWT. From Kemenjiao to No. 5 berth of Kemen Operating Zone, passing Danyu South Watercourse, the fairway’s natural depth is navigable for bulk carriers up to 100,000 DWT.

V Haitan Strait Fairway

With a total length of about 35.7 kilometers, it is from the sea area north of Caoyu Island in mouth of the south part of Haitan Strait to the sea area north of Guyu Island in mouth of north part of Haitan Strait. It is a natural fairway along the sea coast, among which, there is a Shazui shoal between Laolo Watercourse and Siyu Watercourse with the minimum navigable depth of -3.7m. Fairway only for Jinjing Wharf is about 12.2 kilometers long, 80m wide, and the minimum navigable depth is -7.5m. 

The depth of navigable fairway of all the harbor areas of Fuzhou Port will be proclaimed by Fuzhou Fairway Administration Department timely. 

 

Chapter Two   Port Facilities

 

Item 6 Dock Facilities

(At the end of 2005 in Fuzhou Port, there were 134 productive berths, the total length of which was 11.6 kilometer, including 23 berths up to 10,000 tons; Besides there were 9 container and multipurpose berths, the total length of which was 1.607 kilometers, including 3 container berths and 1 multipurpose berth up to 10,000 tons.)

Item 7 Main Mechanical Facilities

I Handling Equipment—13 units of quay -crane with maximum capacity of 61 ton and maximum out-reach distance of 60m.  

II Tugboat capacity & floating crane Capacity—maximum horsepower of tug is 4000HP; Floating crane with capacity up to 80 ton.

Chapter Three   Port Administration and Related Authorities

 

Item 10 Port Administration Authority

    Fuzhou Municipal Port Authority (Fuzhou Fairway Administration Bureau),a branch of Fuzhou Municipal People's Government,is responsible for the administration of port and fairway. Itsjurisdictional areas includes the water area, land area of Fuzhou Port and the inland river fairway from Minjiang River Jiefang Bridge to Minqing Xiongjiang. 

Fuzhou Municipal Port Authority has its direct suboffice in Mawei District, meanwhile, it has also another five suboffices in Lianjiang, Luoyuan, Changle, Fuqing and Pingtan. Fuzhou Fairway Navigation Mark Administration Center, Rescue and Salvage Centre, Monitoring Team are also the branches of Fuzhou Municipal Port Authority. (Fuzhou Fairway Administration Bureau)

    Item 11 Water Traffic Safety Supervision and Administration Authority

    Fuzhou Maritime Safety Administration of the People’s Republic of China (Fuzhou Maritime Safety Administration for short) is the maritime administration authority of Fuzhou Port, responsible for water traffic safety supervision and administration of Fuzhou Port, preventing the port from vessel pollution, and ensuring safety navigation, etc. 

    The subbranches include: Majiang Marine Affairs Office, Taijiang Marine Affairs Office, Guantou Marine Affairs Office, Luoyuan Marine Affairs Office, Songxia Harbor Marine Affairs Office, Fuqing Marine Affairs Office, and Pingtan Marine Affairs Office. 

   Item 12 Other Inspection and Administration Authority

I Mawei Customs and Fuqing Customs under Fuzhou Customs, established by the state in Fuzhou Port, is responsible for supervision and administration over the entry and exit of Fuzhou Port. In accordance with the “Customs Law of the People's Republic of China” and other relevant laws and administrative regulations, they supervise entry-exit border transportation vehicles, cargo, luggage, postal articles and other articles, collect customs tariff and other taxes and fees, uncover and suppress smuggling, work out Customs statistics and handle other Customs operations. 

Mawei Customs is mainly in charge of Minjiang Estuary Inner Harbor Area and Luoyuan Bay Harbor Area. Fuqing Customs is mainly in charge of Jiangyin Harbor Area, Songxia Harbor Area, and Pingtan Jinjing Wharf. 

    II Fuzhou Frontier Defense Inspection Station and Fuqing Frontier Defense Inspection Station are the frontier inspection authorities established by the state in Fuzhou Port. They implement the frontier defense inspection over entry-exit border personnel and their baggage, vehicles and cargo in accordance with the law, monitor entry-exit border vehicles, providing guard over the defined area of the port and keeping nomal order of entry-exit border, executing the tasks entrusted by authority or authorized by the laws and other administrative regulations. 

    Fuzhou Frontier Defense Inspection Station is mainly in charge of the inner harbor area of Minjiang Estuary and Luoyuan Bay Harbor Area. Fuqing Inspection Station is mainly in charge of Jiangyin Harbor Area, Songxia Harbor Area, Yuanhong Wharf and Pingtan Jinjing Wharf.  

III Fuzhou Entry-exit Inspection and Quarantine Bureau and Fuqing Entry-exit Inspection and Quarantine Bureau under the Fujian Entry-exit Inspection and Quarantine Bureau mainly are responsible for the supervision, inspection and quarantine as well as the sanitation treatment over imported and exported cargoes, vessels sailing on international routes, personnel and baggage at their respective harbor area. 

Fuzhou Entry-Exit Inspection and Quarantine Bureau governs the inspection and quarantine tasks at Minjiang Estuary Inner Harbor area, Luoyuan Bay Harbor Area and Fuzhou bonded area. Fuqing Entry-Exit Inspection and Quarantine Office governs entry-exit inspection and quarantine tasks at Jiangyin Harbor Area, Songxia Harbor Area and Pingtan Jinjing Wharf.

IV Vessels sailing on international routes or their agent shall proceed entry-exit formalities in accordance with the legal proceedings defined by the supervision and administration authorities.

 

Chapter Four Vessel Entry and Departure

 

Item 13 Vessel Entry and Departure report

Vessels entering and leaving Fuzhou port shall report to Fuzhou Maritime Safety Administration in accordance with the “Maritime Traffic Safety Law of the People's Republic of China” and “Port Law of The People's Republic of China.” After receiving the report, Fuzhou Maritime Safety Administration shall notify it to Fuzhou Municipal Port Authority promptly. 

I Sailing Plan Report

The sailing plan shall be reported to Fuzhou Maritime Safety Administration General

Duty Office (Tel.:0591-83684018 Fax:0591-83985000), then it shall be transferred to Fuzhou Municipal Port Authority General Duty Office ( Tel.:0591-83682132 Fax:0591-83683227) promptly. 

Contents: the ship’s name, nationality, length over all, gross tonnage, draft, air draft, and port of call, destination port or expected anchorage or berth, estimated time of arriving, variety and quantity of cargo onboard, number of passengers and other relevant information.

    Time limit: before 16:00 (Local Time) the day before estimated day of entry or exit of Fuzhou Port
    Report method: written report from ship owner or ship’s agent
    II Position Report

Vessels entering and leaving Fuzhou port shall report the ship’s position in accordance with the related ship position report specifications declared by Fuzhou Maritime Safety Administration. 

Reporting line:

1. Minjiang Estuary Inner Harbor Area, when the vessel passes the flow-line formed by Bajiaowei (26°06'58"N/119°40'11"E) and the cape of Baiyun Mountain (26°05'33"N/119°38'49"E), she must report her position to Fuzhou Maritime Safety Administration using VHF12 through Fuzhou Radio station. 

2. Jiangyin Harbor Area(waiting for proclamation); 

3. Songxia Harbor Area(waiting for proclamation); 

4. Luoyuan Bay Harbor Area(waiting for proclamation); 

5. Pingtan Island Operating Zone(waiting for proclamation); 

    III Berthing, Unberthing and Anchorage Report

The owner or its agent of the ship or installation which plans to enter the inner anchorage (mooring buoy) or berth of each harbor area shall apply to the General Duty Office of Fuzhou Municipal Port Authority for anchorage or berth in advance, vessel’s berthing or unberthing, dropping anchor, or heaving up anchor shall be reported timely. 
    The report include the following: name of vessel, time of arriving or leaving berth or anchorage, name of berth or anchorage, expected time of berthing. 

    IV Emergency Report of Vessel or Navigation-Hampering

When traffic accident, pollution accident, engine breakdown or personnel casualty or some other emergent cases take place, the vessel shall give off report instantly. If any of the following situations occurs,they shall promptly make a report to Fuzhou Maritime Safety Administration by calling 12395 or 0591-83684018 or using VHF16, VHF70: navigation aids or navigational facilities malfunction or become abnormal; an obstacle or drifting object jeopardizing the safety of navigation is discovered; or there are other abnormal situations jeopardizing the safety of navigation. 

V All the vessels navigating or anchoring shall keep VHF16, VHF70 on watch. During navigating in port area, all vessels shall use VHF6 for communication. 

Item 14 Vessel Visa and Port Entry & Departure Administration

I Vessel Visa

1.When entering or leaving Fuzhou port, or navigating or operating in port areas, the vessels shall obtain port visa from the Marine Affairs under Fuzhou Maritime Safety Administration according to law. The non-operating transportation or operation vessels such as military, police ship as well as athletic ship are excluded. 

    2.A periodical visa system is applied to the vessels’ navigating and operating in harbors. The vessels which meet the following requirement could apply for periodical visa: vessels shuttling between harbors and nearby operating zones; passenger ships navigating along fixed routes, or vessels engaging in short distance transport and operation within the jurisdictional areas of one maritime administration authority or between the jurisdictional areas of two maritime authorities. 

3. If one of the following events takes place before leaving port, the vessel which has

already obtained visa shall apply for it again. 

(1) Change of captain (chief steersman), chief engineer (chief motorman) or the other crew member serving as corresponding duty;

(2) Damage of important navigation equipment;

(3) Change of vessel structure and technical condition;

(4) Alternation of navigating limit and vessel usage;

(5) Failure to leaving port within 36 hours after obtaining departure visa; or

(6) The appearance of other events that do not conform to the visa condition. 

II Port Entry and Departure Administration  

    1. When the vessel sailing on international routes enter or leave the harbor, she or her agent shall firstly apply for the entry permit or departure port clearance. She could only enter the port after obtaining permission and going through the entry and departure procedure in accordance with relevant regulations. 

    2. Inspection authorities shall, in accordance with the provisions of relevant laws and administrative regulations, implement examination over the vessels sailing on international routes that enter or leave the port.

    3. If the vessel fails to sail off Fuzhou Port within 24 hours due to change of circumstances after obtaining the port clearance, she or her agent shall report it to Fuzhou Maritime Safety Administration. And Fuzhou Maritime Safety Administration and other inspection institutions will decide whether the vessel shall go through entry and departure procedure again. 

Item 15 Supervision over Vessels Entry and Departure with Dangerous Cargoes

I When entering or leaving the port with dangerous cargoes, vessels shall report to the maritime administration authority according to the following specifications:

1. When the vessel with carriage of dangerous cargoes enters or leaves the port or makes a transit stop at the port, she shall declare to maritime administration authority for entry 24 hours before her arrival or departure of the port directly or through her agent. And she could only enter or leave the port after getting the approval of maritime administration authority. Vessels sailing on international routes shall also follow the specified time defined Item Six of “Measures for the Inspection of Vessels Sailing on International Routes Entering or Leaving the Ports of the People's Republic of China” to report in advance.  

2. Vessels navigating along fixed routes and carrying fixed categories of cargo may apply for termly declaration.

3. Nuclear energy (power) vessel or vessel carrying radioactive substance shall submit a written application to maritime administration authority and accept special inspection and administration. 
    Fuzhou Maritime Safety Administration shall accept the declaration of vessels carrying dangerous cargoes 24 hours a day. After receiving the declaration of vessel carrying dangerous cargoes entry or leave the port, they shall check the following circumstances such as: seaworthiness, fitness of loading, fitness of transport, antipollution, etc. And they shall determine whether to grant consent or not within 24 hours. 

II Upon entering the port, the tanker and the vessel with carriage of dangerous cargoes shall apply for entry visa immediately; and she shall still apply for departure visa when leaving. Except for weather cause, if the vessel which has obtained departure visa or port clearance fails to leave the port within 36 hours, she shall apply for visa or go though departure procedure again. 

 

Item 16 Pilot

I Pilot Application

When the following vessels are navigating, berthing or unberthing, shifting berth (except for parallel shift between two neighboring berth along the shore) inside the pilot water area, or berthing or unberthing mooring points or loading spots outside of pilot water areas, they shall apply for pilot:   

1. All foreign nationality vessels;

2. Some Chinese nationality vessels:  In order to ensure the safety navigation of the vessel and port facilities, the maritime administration authority jointly with Fuzhou Municipal Port Authority make a proposal for approval by the Ministry of Communications, in which the authorized Chinese-nationality vessels that shall apply for pilot are listed; or

3. Other Chinese-nationality vessels specified by law and administrative regulations that shall apply for pilot; 

Other vessels sailing inside and outside pilot district or berthing, unberthing and shifting berth could apply for pilot on demand. 

The vessel or her agent shall submit pilot application through Fuzhou Municipal Port Authority General Duty Office or Fuzhou Port Pilot Station 24 hours before its arrival, and reaffirm it before 16:00 (Local Time) the day before arrival. If any alteration after the advanced report or reaffirmed report takes place, please inform timely. 

II Pilot Application Information
    The following information of the vessel that need pilot shall be supplied by the vessel or her agent:  
   1.Ship’s owner, name of vessel (both Chinese and English), nationality and call sign;
   2.Vessel type, length over all, greatest breadth, draft, and air draft (the distance from waterline to maximum), dead weight, gross tonnage, net tonnage, the type, power of main engine and thruster, and speed;
   3.The variety and quantity of cargoes;
   4.Estimated time and place of arriving, departing the port or shifting;
   5.Other special information. 
     III Pilot District
    1. Minjiang Estuary Inner Harbor Area: the relevant water areas from Baita in Minjiang Estuary to Taijiang fairway;
    2.Jiangyin Harbor Area: the relevant water area from Tangyu South Pilot Anchorage to Jiangyin Harbor Area; 
    3.Songxia Harbor Area: the relevant water areas from Dongluo Pilot Anchorage to Songxia Harbor Area; 
    4.Luoyuan Bay Harbor Area: relevant water areas from Xiluo Island Pilot Anchorage to Luoyuan Bay Harbor Area. 
   IV Pilot Execution
   Pilot Station shall meet the right pilotage demand requested by the vessel, arrange to provide pilot service timely, and inform the applicant about the pilot arrangement. When piloting particular vessel, pilot station shall first submit the pilot arrangement to Fuzhou Municipal Port Authority and Fuzhou Maritime Safety Administration for approval before carrying out pilotage. 
  V Position Confirmation
    The foreign nationality vessels that have obtained approval to enter specified water area shall wait for the pilot in specified pilot or the tide-waiting region, and keep VHF 16 on watch in the pilot anchorage or tide-waiting anchorage of each harbor area. Once receiving the entering message from the vessel’s agent, the master shall contact pilot boat through VHF 16 to confirm the pilot boarding position and time. 
   VI Pilot station and pilot district:

1.Minjiang Estuary (Baita) pilot embarking and disembarking area:

VII Reject, Suspend or Terminate Pilot Service
    When one of the following events happens, the pilot has the right to reject suspend or terminate pilot service and shall promptly make a report to pilot station and Fuzhou Maritime Safety Administration:   
   1. Bad weather, rough sea;
   2. The piloted vessel is unseaworthy; 

3. The depth of water is not enough for vessel; 

4. The pilot ladder and the illumination of the piloted vessel do not accord with the security specification; 

5. The pilot is uncomfortable and incapable of keeping on piloting; or
   6. Other reasons that are unfit for piloting. 

Before making the above decisions, pilot shall inform the master of the vessel, and make a good arrangement for the security of the vessel, including piloting the ship to a safe place that will not disturb the regular navigating, mooring or operation of other vessels.  
   VIII Pilot Delivery Mode
   The pilot is mainly delivered by pilot boat. 
   Item 17 Vessel Mooring Dock, Mooring Buoy
    When mooring docks or buoys in Fuzhou Port, vessels shall abide by the following provisions:  
    I There shall be enough leathery ropes on the vessel; the lacing shall be tied-up properly. The vessel shall pay attention to the impact of weather and tidal current, and control the tightness of ropes to ensure the security of herself and other vessels.  
    II The Vessel shall take the necessary safety precautions to ensure the personnel security;
    III The vessel shall moor the dock or the buoy according to the specified mooring length and breadth, and moor the appointed berth by the order of the dock operator; 
    IV When mooring the pier, the small vessel shall pay special attention to the ebb and flow to prevent it from being pressed into the dock; 
    V When carrying out the following activities, vessels shall report to Marine Affairs under Fuzhou Maritime Safety Administration for record in advance: 

  • Overhaul boiler, main engine, windlass, steering gears and radio station; 
  • Ship trial, main engine test, mooring test;
  • Life-saving exercise; 
  • Welding or hot work;
  • Hang fancy lantern on the vessel;
  • Adjustment of magnetic compass;
  • Bunkering; or 
  • Other works that may impact the safety of ship and port. 

VI Vessels shall berth the dock according to her capacity;

VII When the berthing is beyond the original design docking capacity, it shall undergo the argumentation and be examined and approved.

  If the berthing is beyond the original design dock’s capacity, the port operator shall arrange the design unit to carry out demonstration and evaluation over port facilities and work out detailed safety entry, departure, navigating, berthing and contingency plan to secure entry-exit of the port and adopt feasible safety ensurance measures, which shall be submitted to the Ministry of Communications forexamination and approval after the censor organized by port administration authorities. 

 Item 18 Prohibited Anchoring Area in the Port

I 100m water area in the upstream and downstream of Qingzhou Bridge is strictly prohibited from any anchoring. 

II 100m in the upstream and downstream of the water catchment for all the waterworks and water transfer project is strictly prohibited from any anchoring. 

Item 19 Mining Prohibition Area

Sand mining is prohibited Inside Minjiang Estuary. 

 

Chapter Five   Port Service Operation

 

Item 20 Application of Port Service Operation

Whoever intends to engage in operation of dock and other port facilities, port service for passenger transport, cargo loading, unloading, lightering and storing in the port area and the operations of tugs in port shall, according to “Port Operating Administration Regulations” of the Ministry of Communications, submit a written application and corresponding documentary information to Fuzhou Municipal Port Authority for a port operation permit, and register with the department for industry and commerce in accordance with law. 

Whoever intends to carry out new-build, rebuild and extension of the frontier port storage shall submit a written application and corresponding documentary information to the Inspection and Quarantine Authority for the “Frontier Port Store Area Health Licenses” and accept the sanitary supervision from national inspection and quarantine authority. 

 

Item 21 Port Cargo Handling
When carrying out the operation of handling, lightering, storing and installing and

disassembling container , etc., the port operator shall sign an operation contract either in written form or other forms with the operation client. 

The operation client shall proceed all formalities related to

port, customs, inspection and quarantine, police and other required formalities related to the cargo transport and operation, all the documents of completed formalities shall be delivered to the port operator. 
    When dealing with cargoes with special storage requirement, the operation client shall make agreement with the port manager on the particular method and condition of cargo storage. 
    Operation client shall deliver cargoes with the name, number of packages, weight, and volume, manner of packing and identification mark to the port operator, according to the details agreed on operation contract. For handling heavy, long and big cargoes, operation client shall declare the general number of packages, weight and volume (length, width, height) as well as the weight length and volume (length, width, height) per unit. The operation client shall bear the responsibility for compensation, if he fails to deliver the cargo and make clear statement according to this provision, which causes loss of port operator. 
    Item 22 Qualification Authentication for Port Operation of Dangerous Cargo

When engaging in dangerous cargo handling, lightering, storing, packing, installing and disassembling dangerous container, the port operator shall, according to the “Port Dangerous Cargo Administratiion Regulations” of the Ministry of Communications, apply to Fuzhou Municipal Port Authority for the qualification authentication for port operation of dangerous cargo. Without port operation certificate for dangerous cargo, the port operator is forbidden to carry out dangerous cargo port operation.
    Item 23 Port Operation of Dangerous Cargo

24 hours before the operation of dangerous cargo handling, lightering, storing, packing, installing and disassembling container, etc, the enterprise engaged in dangerous cargo port operation shall, report the operation client, the descriptions, characteristics, quantity of dangerous cargoes, the time and place for the operations and the safety precaution measures to Fuzhou Municipal Port Authority through Fuzhou Municipal Port Authority dangerous cargo declaration management information system (http://www.fpa.gov.cn ). After receiving the report, Fuzhou Municipal Port Authority shall make the decision whether to grant approval or not within 24 hours, and notify the reporter and the maritime administration authority of the decision. Without approval, the port operator is forbidden to carry out dangerous cargo operation.  

The enterprises engaging in port operation of dangerous cargo shall operate within the confines of dangerous cargo port operation certificate. 

Operation client shall provide the dangerous cargo operators with the correct information including the name of dangerous cargo, nation number or U.N. number, applied package, danger and emergency measures, and ensure them accurate and integrated. Operation client shall not smuggle dangerous cargo in the consigned general cargo or conceal dangerous cargo or misreport it as general cargo. The export of dangerous cargoes, in addition, requires the repetition or photocopy of the dangerous cargo packing employment authenticated document from entry-exit inspection and quarantine authority.  

If the following events take place, the enterprises undertaking dangerous cargo port operation shall handle it promptly, and report it to Fuzhou Municipal Port Authority:  

I Discovery of unreported, or disloyally reported or mistakenly reported dangerous

cargo; or

II Discovery of abhorrent dangerous cargo in general cargo or container. 

Item 24 Cargo Sanitation and Pest-elimination and Vessel Fumigation

Whoever intends to carry out the propagation or sanitation quarantine and pest elimination over entry or exit border cargoes and conxtainer, shall operate in special places constructed for sanitation and pest elimination under the local quarantine authority’s permission and supervision. Before the processing unit begins its operation, a pest elimination plan (include name and quantity of treated cargo, disposal cause and time, place and measure, etc.) shall be worked out and submitted to local inspection and quarantine authority, which will supervise the treating process.

Item 25 Port Cargo Tallying

Whoever intends to engage in the port tallying shall apply for licenses obtained from the Ministry of Communications according to “Port Law of the People's Republic of China” and “Port Operating Management Specification” of the Ministry of Communications. The operator engaged in entry and exit of border cargo tallying shall obtain international freight agent operation permit and submit to the competent customs for the record.

The port operator engaging in cargo loading, unloading and storing shall not concurrently engage in the cargo tallying services, and the port tallyman shall not concurrently engage in the loading, unloading and storing of cargoes. 

Item 26 Tug Operation

Whoever engaged in port tug operation shall apply for operation permit according to “Port Operating Management Specification”, and abide by “Maritime Traffic Safety Law of the People's Republic of China” and “Regulations of the People's Republic of China Concerning the Administration of Traffic Safety on Inland Waters”. 

During the traction towing of floating derrick, pile-driving vessel, pontoon, rising wreck and other rudderless vessel, the corresponding shapes and lights shall be shown as required. 

During navigating, tug team shall have sufficient swerve ability and control ability despite of the type of towed ship and the array of the team. The speed over the ground against current shall be no less than 2 knots.  

Item 27 Port Passenger Traffic Service

Whoever engages in passenger transport service shall apply for operation permit according to “Port Operating Management Specification” of the Ministry of Communications, and abide by “Waterway Passenger Traffic Rule” of the Ministry of Communications. A port operator engaging in passenger transport shall take effective measures to ensure the passengers' safety, provide them with quick and convenient services and keep a good environment for them when waiting to board the vessel; in accordance with law, formulate its emergency plans for evacuation and rescue of passengers in a major accident due to lack of safe production and plans against natural disasters, and shall ensure the implementation of the plans.

 

Chapter Six   Port Service

 

Item 28 Navigation Traffic Communication Services

Fuzhou Radio Station shall keep VHF16 and VHF70 24-hour on watch, ensure the smooth flow of information about vessel accident and safety navigation, and broadcast relevant safety navigation information on VHF16 according to navigation telecommunication regulation. 

Any vessel entering or leaving Fuzhou Port is strictly forbidden to interfere with the normal communication on VHF16. 

Item 29 Supply Service

Fuzhou port can supply the vessel 24 hours a day with fuel oil, lube oil, fresh water, staple and subsidiary provisions, cigarettes, drinks, ship’s store, dunnage materials, ship spare parts, chemical products and arrange all kinds of merchandise according to the personal needs of the seamen . 

Item 30 Building and Repairing Service

There are large scale ship building and repairing enterprises in Fuzhou Port. There are capable of providing all classes of ships with building and repairing service.The list of enterprises in charge of the maintenance of foreign nationality vessels will be notified later by concerned departments. 
    Item 31 Towing Service

Towing service unit of Fuzhou Port can provide the following operations: the mooring or unmooring of the port, traction and convoy, salvation, offshore traction, the mooring or unmooring buoys in inner anchorage, etc. 

Item 32 Assistance and Salvage at Sea

Fuzhou Maritime Search and Rescue Center which is approved and established under Fuzhou People's Government, is responsible for the organization, coordination and command of maritime life salvation, vessel accident salvation and emergency reaction against vessel oil spillage. The office of Search and Rescue Center is located in Fuzhou Maritime Safety Administration. (Tel.:12395,0591-83684018)

 

Item 33 Salvage Service

Shanghai Salvage Bureau of the Ministry of Communications is the primary specialized agency for wreck salvage, emergency salvage, large marine-disaster (including environment) on the sea (water) in Fuzhou Port. 
    Fuzhou Municipal Port Authority Salvation and Salvage Centre shall assist in the vessel salvation and salvage inside Minjiang Estuary.      

Item 34 Sludge and Garbage Disposal

A special unit in Fuzhou Port can deal with sludge and garbage disposal.

 

Chapter Seven   Port Safety and Environment Protection

 

Item 35 Port Facilities Security

“Port Facilities Security Code” and “ship Security Code” of the Ministry of Communications are applicable for the following vessels: passenger vessel of international service (including high speed passenger vessel), cargo vessel with gross tonnage no less than 500-ton (including high speed cargo vessel) and port facilities providing service for mobile offshore drilling platform. 

The port facilities open to the outside world shall obtain “Port Facilities Security Compliance Certificate” issued by the Ministry of Communications. 

Item 36 Safety Supervision

Fuzhou Municipal Port Authorityshall, in accordance with law, conduct supervision and inspection of safe production in the port and maintain patrol of key docks where masses of passengers embark and disembark or relatively large quantities of cargoes are loaded and unloaded, or which are used for special purposes. If hidden dangers threatening safety are found during inspection, it shall instruct the party under inspection to eliminate, immediately or within a time limit, such dangers.

Item 37 Accident and Disaster Emergency Rescue

Fuzhou Municipal Port Authority shall, formulate port contingency plan against accidents due to dangerous cargoes in port that may jeopardize public interests, emergency plans for evacuation and rescue of passengers in a major accident due to lack of safe production and plans against natural disasters, and shall establish a sound port emergency. Shipping companies, port operators and relevant administration departments of the port shall cooperate with the implementation. 

Whoever intends to engage in the dangerous cargo handling of dock, berth and port shall formulate the preplan on incident emergency of the dangerous cargoes of the this unit, deploy emergency rescue personnel and necessary urgent rescue material, equipment and organize termly drilling. In case of dangerous cargo accidents and emergent production security incidents, port operators shall report to Fuzhou Municipal Port Authority immediately.
    The vessel carrying dangerous cargo shall work out measures to ensure personnel, property security and to prevent environment pollution from the vessel, compile emergency plan dealing with maritime traffic accident, dangerous cargo spillage accident as well as the emergency plan for vessel oil spillage, deploy emergency rescue personnel and necessary salvage material and equipment. 

Item 38 Maintenance, Administration and Protection of Fairway, Navigation Aids   Fuzhou Municipal Port Authority (Fuzhou Fairway Administration Bureau) has

worked out corresponding fairway construction and maintenance standard based on relevant regulations of law. Fairway, navigation aids and other facilities concerned with navigation are protected by the nation, and any unit or individual is prohibited from encroaching or destroying them illegally. 

I Management of Project Related to Navigation

Whoever intends to engage in building or setting across-the-fairway installations including buildings and structures within the fairway planning control line shall, comply our country's technical specifications. The design scheme shall be submitted to the fairway administration authority for examination before application for construction license. After examination, the design scheme which need revision shall be adjusted for examination again. The proposal that shall be subjected to the approval of maritime administration authority according to the provisions of law and administrative regulations related to maritime traffic safety shall also be submitted to Fuzhou Maritime Safety Administration for authorization. 
    The builders of the above-mentioned building, structures or other facilities related to navigation shall inform the fairway administration authority before operation; They shall clean the hangovers in time in accordance with the navigation requirements after completion, and  the fairway administration authority and maritime administration authority will take part in verification.

If the above facilities may affect safety navigation, builders or manager shall set alarm sign according to relevant technical requirement and take charge of the routine maintenance and management. 
    II Fairway Management and Protection

The fairway administration shall carry out periodic measurement and maintenance operation over public fairway. 

All the unit and individual are required to protect fairway and prevent any of the following behaviors that may impact or destroy navigation condition:
    1. Encroach of fairway by river filling or beach filling;
    2. On the side slope, bank protection revetment or the bank, earth mounding, earth excavating, planting of scarification plant; dumping wastes or stacking up other sliding cargoes on the bank; 
    3. Excavating sand and stone, clay, or explosion that may impact regular service or worsen the navigation condition. 
    4. Destroy, damage or occupy fairway facilities; 

5. Planting hydrophyte within the water area, setting fixed fishing gear and fishing stakes, proceeding aquiculture; 

6. Occupy fairway to proceed cargo handling operation; or 

7. Other behaviors that may impact or destroy navigation condition. 
   III Navigation Mark Management and Protection

It shall be forbidden to damage navigation aids or navigational facilities, or affect the efficacy of navigation aids. 
   When displacement, drift, loss or abnormal performance of navigation mark occurs, or sunken object, floating object, stranded object, etc. that may impact safety navigation appears, it shall be reported to Maritime Safety Administration and navigation mark administration authority promptly.

The owner, user or the manager of the sunken object, floating object or stranded object shall set navigation mark according to the demand of navigation mark administration authority. Being incapable of setting the navigation mark as required, they shall appoint the navigation mark maintenance unit to set the navigation mark meanwhile and assume the related expenses. 

IV With respect to sunken or drifting objects that may affect the safety of navigation and the management of navigation lanes, as well as those constituting a threat of explosion, the owners or managers thereof shall salvage and remove such objects within a deadline set by maritime administration authority. Otherwise,maritime administration authority shall have the right to take measures to compel the salvage and removal of the objects, and their owners or managers shall bear all the expenses incurred thereby.

Whoever intends to salvage of wreck vessels, sunken object or floating object shall apply to maritime administration authority for approval.

Item 39 Port Environment Protection

Port operator shall take effective measures according to relevant environmental protection law and regulations to prevent environment from pollution and damage. 

The construction of port project shall proceed environmental impact assessment according to law. The safety device and environmental protection facility shall be designed, constructed and brought into action synchronously with the main construction. The construction that may impact the safety navigation shall pass safety navigation argumentation. 

    Item 40 Vessel Pollutant Disposal Control

Any vessel shall carry out the routine collection, assortment and storage of vessel garbage; and the vessel shall not discharge residual oil, waste oil, cargo leavings, vessel waste, and construction slurry, and ballast water, tank cleaning water, bilge water and domestic sewage as well as poisonous and harmful substances exceeding specific standards in Fuzhou Port water areas. If the discharging is necessary, it shall meet the national pollutant discharging demand and standard. The vessel shall apply to local maritime affairs department 24 hours before discharging for approval and consign qualified pollutant receiving process unit to receive and dispose the discharging. If the garbage contains dangerous substances or other poisons and harmful substance, the vessel shall provide the pollutant receiving process unit with information of the name, quality and quantity of the substance. 

When the vessel carries out the deck washing spotted with pollutant, poisonous and dangerous substance, she shall submit application to the Marine Affairs Office together with vessel name and cargo name, property as well as expected operation time, etc. The Marine Affairs Office under Fuzhou Maritime Safety Administration shall decide whether to grant the permission or not within a working day after receiving the application (in some particular case it shall be handled on spot ). 

The pumping out of ballast and discharging of garbage from any vessel sailing on international routes shall obtain the permission from port inspection and quarantine authority and follow up inspection and quarantine law and regulations.

    Item 41 Vessel and Relevant Operation Antipollution Control

The vessels shall apply to Fuzhou Maritime Safey Administration for examination and approval, when they carry out tank cleaning (including crude oil washing), cleaning, degas, using incinerator, discharging ballast water, residual oil, oil-contaminated water  reception, outboard copy paper and oil painting, bulk liquids pollution, dangerous cargo lighterage, vessel building and repair, salvage and disassemble as well as other above-water and underwater construction etc. within Fuzhou Port water area. When oil dispersants are needed in dealing with the water pollution caused by vessel, dock or facility, the oil dispersants trademark, planned dosage and deployment location shall be submitted to Fuzhou Maritime Safety Administration for examination and approval before application. 

Item 42 Marine Risk, Traffic Accident, Polluted Water Treatment
    When marine risk or traffic accident occurs to the vessel or installation in Fuzhou Port, the name of the vessel or installation, accident time, location, and damaged extent, salvation demand, marine risk and accident cause shall be reported to Fuzhou Maritime Safety Administration or its subdominant offices by the fastest way. Within 24 hours after the maritime traffic accident, the vessel or installation involved in the maritime traffic accident shall submit a written “Maritime Traffic Accident Report” together with relative materials to Maritime Safety Administration or its subordinate Marine Affairs Office and accept investigation and handling of the accident.

Any vessel or installation pollutes the water area in Fuzhou Port, they shall report to Fuzhou Maritime Safety Administration or its subordinate office and adopt measures to control or abate pollution damage and notify the events to the units that may be impacted by the pollution damage. 

Once receiving the accident report of vessel or installation marine risk, traffic accident or water pollution, Fuzhou Maritime Safety Administration shall organize and coordinate the emergency plan according to characteristics of accident, extent of damage and salvation demand. Vessel and port operator is amenable to participate in the emergency rescue of pollution accident and follow the order of Fuzhou Maritime Safety Administration. 

While being investigated by the maritime administration authority, the parties involved in the maritime traffic accident or pollution accident and relevant personnel must give a truthful account of circumstances at the scene of the accident and other relevant information.

 

Item 43 Port Water Area and Project Forbidding Act

Aquaculture and planting in the water area of Fuzhou Port is prohibited. Dumping of soil and sand and stone into the water area of Fuzhou Port and discharging of noxious and harmful substances in excess of the specified norms in violation of laws and regulations concerning environmental protection are prohibited.

Excavation, demolition and other activities in Fuzhou Port that may threaten port safety are prohibited; but where such activities are really needed for construction or other purposes, the necessary protective measures for safety shall be taken and the activities shall be reported to Fuzhou Municipal Port Authority for approval; and where, according to the provisions of the laws and administrative regulations concerning waterway traffic safety, approval by Fuzhou Maritime Safety Administration is required, such activities shall, in addition, be reported to Fuzhou Maritime Safety Administration for approval.

Item 44 Port Clear Ensurance

In conditions where passengers and cargoes are held up so that the port is blockaded, Fuzhou Municipal Port Authority shall take effective measures in time to regulate the flow of passengers and cargoes.

When it deems it necessary, Fuzhou Municipal People's Government. may directly take measures to do so.

 

Chapter Eight   Supplementary Provisions

 

Item 45 This charter shall also be submitted for filing by the Ministry of Communications of People's Republic of China, and Fujian People's Government and Fuzhou Municipal People's Government.  

Item 46 This charter shall go into effect as of the date of promulgation.
